Kroll Ontrack appoints legal technology expert in Asia
Minneapolis – Dec. 2, 2008 – Kroll Ontrack®, the industry leader in electronic discovery, computer forensics, electronically stored information (ESI) consulting, jury consulting and courtroom presentation services, today announced the appointment of Kenneth V. Nourse as a managing director in Asia. In this role, Nourse will offer clients comprehensive computer investigation and technology solutions in support of legal proceedings, regulatory matters and investigations.
With over 10 years of legal and technology experience, Nourse is charged with providing options and recommendations to both law firms and corporate clients on the complexities and issues related to ESI, including responding to requests for ESI stemming from U.S. litigation, international commercial arbitration, internal corporate investigations, and matters arising under the Foreign Corrupt Practice Act (FCPA) and other governmental regulations, which often require American companies doing business internationally to gather and evaluate data from other countries, commonly in multiple languages. Nourse is based in Hong Kong, which serves as the regional headquarters for Kroll Ontrack and its parent company, Kroll Inc.
Nourse's move to Asia from Kroll Ontrack in Boston, Massachusetts is a reflection of the increased demand from lawyers and corporate clients in Asia to manage ESI effectively, from pre-litigation through investigation. "In working with many lawyers in the region—in Tokyo, Shanghai, Hong Kong and Seoul—it is apparent that lawyers here face the same ESI challenges as their counterparts in North America and Europe. With 90% of all documents now created electronically, it is critical for lawyers and IT specialists to understand how to manage and store their ESI to avoid lost time and costly expenses when they are required to respond to a legal crisis in a limited amount of time," said Nourse.

During his time in the United States, Nourse advised on a number of American discovery cases involving corporations either based or with a presence in Asia. Prior to joining Kroll Ontrack, Nourse was a litigator in the Boston office of Edwards, Angell, Palmer & Dodge and represented clients in intellectual property disputes as well as complex commercial and real estate matters.
